Heye and Piano determined that any such promises were meaningless, in light of the employers’ reservation of the unilateral option to modify or terminate those promises at any time. Piano, 2005-NMCA-018, ¶ 14; Heye, 2003-NMCA-138, ¶ 15. The apparent covenants of the employers were therefore illusory, and the arbitration contract clauses were resultingly void for lack of consideration to the employees. Piano, 2005-NMCA-018, ¶ 14; Heye, 2003-NMCA-138, ¶ 15.
